1. Seller

These Terms of Sale apply to all purchases made through this website:

By placing an order on this website, the client confirms that they have read, understood, and accepted these Terms of Sale.

2. Products

The products offered on this website may include original artworks, paintings, drawings, limited edition prints, and other artistic objects.

Each artwork is described as accurately as possible. However, slight variations in color, texture, scale, paper, finish, or appearance may occur due to screen settings, photographic reproduction, printing processes, or the handmade nature of the work.

Such variations do not constitute a defect.

3. Prices

Prices are displayed in EUR or in the local currency made available through the website interface, where applicable.

Customs duties, import taxes, VAT, handling fees, or other local charges may be added where applicable and are the responsibility of the client unless otherwise stated.

The seller reserves the right to modify prices at any time. The price applicable to an order is the price displayed at the time the order is confirmed.

4. Orders

An order is considered confirmed once the client has completed the checkout process and payment has been successfully received.

The seller reserves the right to refuse or cancel any order in case of payment issues, incorrect information, suspected fraud, abusive behavior, technical error, or unavailability of the artwork.

The order may begin to be processed, produced, signed, numbered, reserved, or prepared specifically for the client after confirmation.

The client may request the cancellation of an order within 24 hours of placing the order by contacting Cecilia Mendoza at cecilia@cmvisualartist.com.

Cancellation requests made within these 24 hours will be considered only if the order has not yet been processed, produced, signed, numbered, certified, packed, or shipped.

After this period, or once the artwork has entered preparation, production, signing, numbering, certification, packing, or shipping, the order can no longer be cancelled.

5. Payment

Payment is due in full at the time of order, unless otherwise agreed in writing.

Accepted payment methods are those displayed at checkout.

The order will not be shipped until full payment has been received.

6. Production and preparation time

Some artworks may be available immediately, while others may be produced, printed, signed, numbered, framed, packed, or prepared after the order is confirmed.

Estimated production or preparation times, when indicated, are provided for information only and may vary depending on the nature of the artwork, studio workload, supplier delays, or shipping constraints.

The seller will make reasonable efforts to keep the client informed in case of a significant delay.

7. Shipping and delivery

Worldwide shipping is offered free of charge unless otherwise stated for a specific exceptional case.

Orders are shipped to the delivery address provided by the client at checkout.

The client is responsible for providing complete and accurate delivery information. The seller is not responsible for brokerage procedures, delays, failed deliveries, or additional costs caused by incorrect or incomplete address details.

Shipping times may vary depending on destination, carrier, customs processing, weather conditions, strikes, force majeure events, or other circumstances beyond the seller’s control.

Once the artwork has been shipped, a tracking number may be provided where available.

8. Customs duties and import taxes

For orders shipped outside France / the European Union, customs duties, import taxes, VAT, brokerage fees, handling fees, or other local charges may apply.

These charges are not included in the artwork price or shipping cost unless explicitly stated.

They are the sole responsibility of the client.

Refusal to pay customs duties, import taxes, or related fees does not constitute a valid reason for cancellation, refund, or return.

9. Returns and right of withdrawal

Due to the specific nature of artworks, original paintings, drawings, limited editions, signed works, numbered works, made-to-order prints, personalized prints, commissioned artworks, and nominative editions, returns and cancellations are not accepted once an order has been confirmed and processing, production, signing, numbering, certification, personalization, packing, or shipping has begun, except where mandatory consumer protection law provides otherwise.

10. European Union 

EU consumer rules provide a 14-day withdrawal right for many distance purchases, with exceptions including customised or made-to-order goods. 

For this reason, the right of withdrawal does not apply to:

- Original paintings;

- Original drawings;

- Commissioned artworks;

- Made-to-order prints;

- Personalised prints;

- Signed Artworks;

- Works produced according to the client’s specific request;

- Limited editions;

- Any artwork that has been customised, reserved, produced, signed, numbered, or prepared specifically for the client.

By placing an order for such works, the client expressly acknowledges and accepts that the right of withdrawal may not apply in accordance with applicable consumer protection laws.

11. Damaged or defective artworks

If an artwork arrives damaged, the client must contact the seller at cecilia@cmvisualartist.com within 48 hours of delivery.

The client must provide:

- Clear photographs of the damaged artwork;

- Clear photographs of the packaging;

- Clear photographs of the shipping label;

- A written description of the issue.

The original packaging must be kept until the matter has been reviewed.

Depending on the situation, the seller may propose a repair, replacement, partial refund, full refund, or another appropriate solution.

12. Intellectual property

The purchase of an artwork, print, painting, drawing, or commissioned piece does not transfer copyright or intellectual property rights to the client.

All images, artworks, designs, compositions, texts, photographs, and visual materials remain the intellectual property of Cecilia Mendoza, unless otherwise agreed in writing.

The client may not reproduce, copy, scan, photograph, publish, modify, sell, license, distribute, mint as NFT, use commercially, or otherwise exploit the artwork or its image without prior written permission.

The purchase grants ownership of the physical artwork only, not the right to reproduce or commercially use the image.

13. Use of images

The seller reserves the right to use images of sold artworks, commissioned works, works in progress, studio views, details, and final pieces for portfolio, archive, exhibition, social media, press, website, promotional, and documentation purposes, unless otherwise agreed in writing.

If confidentiality is required for a commission, this must be agreed in writing before the order is confirmed.

14. Certificate of authenticity

For original paintings and original drawings, the invoice and the Certificate of Authenticity are sent electronically to the client by certified email via PEC. These documents form part of the artwork’s provenance and must be kept carefully together by the client.

The Certificate of Authenticity includes the identifying details of the artwork, such as title, year, medium, dimensions, and any other relevant information necessary to identify the work.

Limited edition prints are accompanied by a physical Certificate of Authenticity, shipped with the artwork where applicable. The certificate may include authentication details such as title, year, medium, dimensions, edition size, numbering, signature, and any other relevant documentation.

15. Limitation of liability

The seller is not liable for indirect losses, loss of profit, loss of opportunity, emotional distress, customs delays, carrier delays, or consequences caused by incorrect information provided by the client.

Nothing in these Terms of Sale excludes or limits rights that cannot be excluded under applicable consumer law.

16. Force majeure

The seller shall not be held responsible for delays or failure to perform obligations caused by events beyond reasonable control, including but not limited to natural disasters, strikes, transport disruptions, customs delays, supplier delays, illness, accidents, war, pandemics, technical failures, or government restrictions.

17. Personal data

Personal data collected during the order process is used only for order processing, payment, shipping, customer service, accounting, and legal obligations.

18. Governing law

These Terms of Sale are governed by the laws of France, unless mandatory consumer protection rules provide otherwise.

In case of dispute, the client is encouraged to contact the seller first in order to seek an amicable solution.
